roe vs wade essay Because neither interest is strong essay, compelling before the second trimester, the State may not regulate abortion in the first trimester either to preserve the woman’s health or to protect the life of the unborn child. Id . at 163. Writing Lined? After the strong essay words, first trimester, however, the essay for frankenstein, State may regulate the performance of an abortion, but only for the purpose of preserving the woman’s health, not for the purpose of strong essay protecting the life of the unborn child. Analysis Essay? After viability, the State may regulate, and even prohibit, abortion to protect the life of the unborn child, except when the performance of the strong essay words, abortion is necessary to preserve the life or health of the woman. Id . at 164-65 (summarizing holdings).

The abortion statutes challenged in Roe , which prohibited abortion throughout pregnancy except to save the life of the mother, did not conform to essay for frankenstein, the Court’s “trimester” framework. Accordingly, they were declared unconstitutional. Id . at essay 164. In Roe , the solving, Court also held that an strong essay words unborn child is not a “person” as that word is used in § 1 of the Fourteenth Amendment and, therefore, is not protected by either the deductive thesis, Due Process Clause or the Equal Protection Clause, id . at strong words 156-59, a holding from which no Justice on the Court – then or since – has dissented. In Roe’s companion case of Doe v. Bolton , 410 U.S. 179 (1973), decided the same day as Roe , the Court struck down various procedural requirements imposed by a Georgia abortion statute based on § 230.3 of the Model Penal Code (that the abortion be performed in a selection, a licensed and accredited hospital, that the procedure be approved by the majority of a medical staff committee of the hospital, and that two other physicians in addition to the attending physician certify that the abortion was necessary for one of the reasons specified in words, the statute).

3 410 U.S. at 192-200. The Court also rejected a vagueness challenge to cause effect essay war 1, what remained of the substance of the statute after major provisions of the statute had been declared unconstitutional by a federal district court. Id . at strong 191-92. 4 Both Justice Byron White and Justice William Rehnquist dissented from the opinions in Roe and Doe striking down the Texas and Georgia abortion statutes. Roe , 410 U.S. at 171 (Rehnquist, J., dissenting); Doe , 410 U.S. at 221 (White, J., dissenting from both opinions); id . at 223 (Rehnquist, J., dissenting).

I. The Origins of a Constitutional Right ^ top. Roe , as noted in the Introduction, was based on the right of privacy. As Roe itself acknowledged, however, “[t]he Constitution does not explicitly mention any right of privacy. 410 U.S. at 152. Analysis? Nevertheless, in a line of decisions going back to the late nineteenth century, “the Court has recognized that a right of strong words personal privacy, or a guarantee of certain areas or zones of writing paper privacy, does exist under the Constitution. Words? Id . This right of privacy, “founded in the Fourteenth Amendment’s concept of personal liberty, the Court in Roe held, “is broad enough to problem solving answers for interviews, encompass a woman’s decision whether or not to terminate her pregnancy. Id . at 153. The roots of a right of personal privacy have been found in the U.S. Constitution in the following places: in the free speech guarantee of the strong words, First Amendment, which has been held to protect the possession of pornography in one’s home, Stanley v. Georgia , 394 U.S.

557, 564 (1969); in the Fourth Amendment, which secures the right of the solving answers for interviews, people against “unreasonable searches and seizures of their “persons, homes, papers and effects, and the Fifth Amendment, which prohibits compulsory self-incrimination, see Boyd v. United States , 116 U.S. 616, 630 (1886) (Fourth and Fifth Amendments protect against all governmental invasions “of the sanctity of a man’s home and the privacies of life”); in the Ninth Amendment, which preserves other rights not enumerated in the Constitution, Griswold v. Connecticut , 381 U.S. 479, 486 (1965) (striking down statute prohibiting use of contraceptives by married couples) (Goldberg, J., concurring) ; in the “penumbras (shades) of the strong, Bill of Rights as a whole, Griswold , 381 U.S. at 484-85 ; and in essay for frankenstein, the liberty language of the strong words, Due Process Clause of § 1 of the Fourteenth Amendment, Meyer v. Answers? Nebraska , 262 U.S. 390, 399 (1923) (striking down a state statute forbidding the teaching of any subject in any language other than English, or the teaching of modern foreign languages below the eighth grade). The right of privacy, the strong words, Court in Roe noted, also has “some extension to lined paper, activities relating to marriage, . . . procreation, . . . family relationships, . . . and child rearing and strong, education. 410 U.S. at 152-53 , citing the following cases: Loving v. Virginia , 388 U.S. 1, 12 (1967), recognizing liberty interest in effect world, marrying the strong essay words, person of one’s choice; Skinner v. Oklahoma , 316 U.S. 535, 541-42 (1942), striking down statute mandating sterilization of certain recidivists; Eisenstadt v. Baird , 405 U.S. 438 (1972), striking down statute prohibiting distribution of contraceptives to unmarried persons; Prince v. Paper? Massachusetts , 321 U.S.

158, 166 (1944), recognizing authority of parents over their children, but upholding child labor laws as applied to the children of Jehovah’s Witnesses who were distributing religious literature in exchange for voluntary contributions; Pierce v. Society of Sisters ,268 U.S. 510, 535 (1925), striking down statute mandating public education of children between the ages of eight and sixteen; and Meyer v. Nebraska (holding described above). II. Critique of Roe’s Privacy Theory ^ top. The Supreme Court’s reliance on strong essay, privacy theory to problem for interviews, support a right to strong, abortion is problematical at US several levels. Strong? First, as the Court itself recognized, Roe , 410 U.S. at 152, the problem solving, Constitution itself “does not expressly mention any right of strong essay words privacy.” To be sure, as Justice Hugo Black noted in his dissent in Griswold v. Connecticut , 381 U.S. 479, 508-10 (1965) (Black, J., dissenting), various provisions of the Bill of how to US Rights protect specific privacy interests, for example, the First Amendment’s right of associational privacy, the Fourth Amendment’s protection against unreasonable searches and strong, seizures and the Fifth Amendment’s prohibition of paper compelled self-incrimination. But the Constitution does not create a general right of privacy. See , e.g ., Katz v. United States , 389 U.S.

347, 350 (1967) (Fourth Amendment, which “protects individual privacy against certain kinds of governmental intrusions,” “cannot be translated into a general constitutional ‘right to strong, privacy’”). Recognition of a “general constitutional ‘right to privacy’” cannot be reconciled with the care with which the writing lined paper, Framers of the Bill of strong essay Rights described the specific rights that were being secured. Second, the concept of “privacy” is amorphous and chameleon (or, in Justice Black’s words, “broad, abstract and ambiguous,” Griswold , 381 U.S. at 509 ). Roe’ s attempt to collect cases under the a selection english, rubric of “privacy” – a term that does not even appear in most of the strong essay words, cases cited – simply creates an artificial common denominator among a very disparate and largely unrelated group of cases that have nothing to do with the subject of abortion, as the Court in Roe freely admitted: “The situation [involving a pregnant woman and her unborn child] . . . is inherently different from marital intimacy, or bedroom possession of obscene material, or marriage, or procreation, or education, with which Eisenstadt and Griswold , Stanley , Loving , Skinner , and writing lined, Pierce and Meyer were respectively concerned.” 410 U.S. at 159 (emphasis added). 6 If a pregnant woman’s decision whether or not to carry her pregnancy to term is “inherently different” from all of the “privacy” cases on which the Court relied, then it is difficult to essay, understand how those cases could possibly support recognition of a right to deductive thesis, obtain an abortion. Third, most of the cases Roe cited in support of its privacy theory were decided under one or another of the provisions in the Bill of Rights. Roe itself, however, derived the right of privacy (and a subsidiary right to abortion) from the essay words, liberty language in analysis, the Due Process Clause of the Fourteenth Amendment, 410 U.S. at 153, not from any of the specific guarantees set forth in the Bill of strong essay words Rights.

That directly contradicted the Court’s express refusal, only a few years earlier in Griswold , 381 U.S. at 481-82, to rely upon the Due Process Clause in postulating a right of privacy. Fourth, even with respect to the Due Process Clause, the Court no longer examines substantive due process claims (of which, more below) through the lens of privacy, and essay for frankenstein, that includes the subject of abortion. In reaffirming the “core holding” of Roe – that the State may not prohibit abortion before viability for any reason or after viability if the pregnant woman’s life or health would be endangered by strong words continuing the pregnancy – the Court, in Planned Parenthood v. Casey , 505 U.S. 833, 846-53 (1992), relied upon the liberty language of the Due Process Clause of the Fourteenth Amendment, not upon privacy theory. How To US? 7 See also Cruzan v. Director , Missouri Dep’t of Health , 497 U.S. 261, 279 n. 7 (1990) (analyzing right to refuse unwanted medical treatment “in terms of a Fourteenth Amendment liberty interest, rather than under a “generalized constitutional right of privacy”). Focusing more particularly on the Fourteenth Amendment, § 1 thereof provides, in relevant part, that no State shall “deprive any person of life, liberty, or property, without due process of law . . . .” As its language suggests, the Due Process Clause is concerned with the process by strong essay words which a person may be deprived of life, liberty or property, not the substance of the law authorizing such deprivation. See Lawrence v. Of Modern? Texas , 539 U.S. 558, 592 (2003) (Scalia, J., dissenting) . It was never the intent of the Framers of the Fourteenth Amendment that the Due Process Clause would serve as a battering ram to knock down statutes the substance of which offended the sensibilities of a majority of Justices who happen to sit on strong words, the Supreme Court from solving for interviews time to time. See Raoul Berger, Government by essay words Judiciary The Transformation of the writing lined paper, Fourteenth Amendment (Liberty Fund 2d ed.

1997) 221-39, 273-306. 8 Despite its focus on process, the Due Process Clause, at various times in our history, has been given substantive content, resulting in the invalidation of words state laws thought to be inconsistent with prevailing understandings of solving for interviews “liberty.” The paradigmatic case in essay words, this area, before Roe v, Wade was decided in 1973, is how to success, Lochner v. New York , 198 U.S. 45 (1905). In Lochner , the strong words, Supreme Court, over the vigorous dissent of Justice Oliver Wendell Holmes, Jr., held that state legislation setting limits on problem answers, the number of hours a person could work in a bakery daily (ten hours) and weekly (sixty hours) violated the liberty of an employer to essay, contract with his employees on terms that were mutually agreeable to them. The notion that the Due Process Clause has substantive (as opposed to only procedural ) content bedeviled constitutional adjudication for a generation, until it was laid to rest, at a selection of modern english essays least with respect to the review of social and economic legislation, in strong essay, West Coast Hotel v. Parrish , 300 U.S. 379 (1937), which upheld a minimum wage law. Twenty-five years later, the Supreme Court could state that it had “returned to deductive thesis statement, the original constitutional proposition that courts do not substitute their social and economic beliefs for the judgment of essay words legislative bodies.” Ferguson v. Skrupa , 372 U.S. 726, 730 (1963). Despite the interment of what may be called “economic” substantive due process, “libertarian” substantive due process is alive and well. Analysis Essay? Under this strand of substantive due process analysis, the strong essay, Due Process Clause “provides heightened protection against government interference with certain fundamental rights and liberty interests.” Washington v. Glucksberg , 521 U.S. 702, 720 (1997).

Roe v. Paper? Wade , while sounding in privacy theory, was ultimately based on strong essay words, the liberty language of § 1 of the Due Process Clause of the Fourteenth Amendment, see Roe , 410 U.S. at 153, and, therefore, may justly be regarded as the modern paradigm of (libertarian) substantive due process analysis. See Richard Epstein, Substantive Due Process by Any Other Name , 1973 Sup. Ct. Rev. 159, 184. But Roe flunks the test the Court uses for problem for interviews evaluating substantive due process claims. In determining whether an asserted liberty interest (or right) should be regarded as fundamental for purposes of substantive due process analysis (infringement of which would call for strict scrutiny review), the Supreme Court applies a two-prong test. First, there must be a “careful description” of the asserted fundamental liberty interest. Strong Words? Glucksberg , 521 U.S. at 721 (citation and internal quotation marks omitted).

Second, the interest, so described, must be firmly rooted in “the Nation’s history, legal traditions, and practices.” Id. at 710. An asserted interest in (or right to) abortion does not meet the second prong of the effect world, Glucksberg test. Words? Quite the contrary. As much research has established, especially that of Professor Dellapenna ( see n. 4, supra ) , abortion was a crime in English and in the US, American common law, at strong essay least after “quickening” (that stage of pregnancy when the woman first detects fetal movement, usually sixteen to statement, eighteen weeks’ gestation), and very possibly without such a limitation. With the gradual replacement of common law crimes by statutory crimes in the nineteenth century, the essay, overwhelming majority of States had made the performance of an effect abortion at any stage of pregnancy a crime well before the Fourteenth Amendment was adopted in 1868.

And the case law interpreting these statutes revealed that the principal, if not exclusive, purpose in words, enacting these statutes was to protect unborn human life, not (or not solely) to safeguard women from dangerous medical and/or surgical procedures. See Paul Benjamin Linton, Planned Parenthood v. Casey : The Flight from Reason in the Supreme Court , XIII St. Louis U. Pub. A Selection? L. Rev. 15, 109-15 (1993).

In light of the foregoing, an interest in strong essay words, (or right to) abortion cannot be said to be firmly rooted in our “history, legal traditions, and practices.” III. A Selection Of Modern? Applications of Roe ^ top. The Supreme Court has decided almost three dozen abortion cases since and including Roe v. Wade and Doe v. Bolton . A detailed analysis of the holdings in these cases would unduly prolong the strong, length of success in the this essay. Strong Essay? The principal holdings, however, may be briefly summarized: In addition to the Texas abortion statutes struck down in Roe , the Court has struck down state statutes prohibiting particular abortion methods, Planned Parenthood of Central Missouri v. Danforth , 428 U.S. 52, 75-79 (1976) (saline amniocentesis), Stenberg v. Carhart , 530 U.S. Cause Essay War 1? 914 (2000) (partial-birth abortion), but more recently has upheld the federal Partial-Birth Abortion Ban Act, Gonzales v. Carhart , 550 U.S. 124 (2007).

The Court has upheld statutes prohibiting non-physicians from performing abortions, Mazurek v. Essay Words? Armstrong , 520 U.S. 968 (1997) ( per curiam ) and has held that non-physicians may be prosecuted for performing abortions, Connecticut v. How To Success US? Menillo , 423 U.S. 9, 11 (1975) ( per curiam ) . The Court has struck down statutes and ordinances requiring all abortions (or all abortions after the first trimester) to be performed in hospitals, Doe v. Strong Words? Bolton , 410 U.S. 179, 193-95 (1973) (all abortions), City of Akron v. Akron Center for Reproductive Rights ( Akron Center I ) , 462 U.S. 416, 431-39 (1983) (all abortions after the first trimester), Planned Parenthood Ass’n of Kansas City , Missouri , Inc. v. Problem Solving For Interviews? Ashcroft , 462 U.S.

476, 481-82 (1983) (all abortions after the first twelve weeks of pregnancy), but has upheld a statute requiring all second trimester abortions to be performed in either a hospital or a licensed outpatient clinic, Simopoulos v. Virginia , 462 U.S. Essay? 506, 510-19 (1983). The Court has struck down parental consent and notice statutes and a selection english essays, ordinances if they did not contain a judicial bypass mechanism that would afford the pregnant minor the opportunity to avoid obtaining the consent of (or giving notice to) her parents or legal guardian, 9 Danforth , 428 U.S. at 72-75 (one-parent consent), Akron Center I , 462 U.S. at 439-42 (one-parent consent without judicial bypass), Bellotti v. Baird , 443 U.S. 622 (1979) (two-parent consent) (inadequate judicial bypass), Hodgson v. Minnesota , 497 U.S. 417, 450-55 (1990) (two-parent notice without judicial bypass), 10 but has upheld statutes that contained an adequate judicial bypass, Ashcroft , 462 U.S. at strong 490-93 (one-parent consent). Hodgson , 497 U.S. at 497-501 (Kennedy, J., concurring in the judgment in part and dissenting in part), id. at 461 (O’Connor, J., concurring in part and problem solving, concurring in the judgment in part) (two-parent notice with judicial bypass), Ohio v. Akron Center for Reproductive Health ( Akron Center II ) , 497 U.S.

502 (1990) (one-parent notice with judicial bypass), Planned Parenthood v. Casey , 505 U.S. 833, 899-900 (1992) (one-parent consent), Lambert v. Strong Essay Words? Wicklund ,520 U.S. Solving Answers? 292 (1997) (one-parent notice) ( per strong, curiam ) . In The US? The Court has struck down statutes requiring a married woman to obtain the strong words, consent of, or give notice to, her husband before undergoing an abortion, Danforth , 428 U.S. at 67-72 (consent), and Casey , 505 U.S. at 887-98 (notice) . Writing Lined? The Court has upheld state and federal statutes restricting public funding of abortions, Beal v. Doe , 432 U.S. 438 (1977), Maher v. Roe , 432 U.S. 464 (1977), Harris v. McRae , 448 U.S.

297 (1980), and Williams v. Strong? Zbaraz , 448 U.S. 358 (1980), as well as state statutes and deductive thesis, municipal government policies prohibiting the performance of abortions by public employees within the scope of their employment or in strong, publicly owned and operated facilities (other than those necessary to english essays, save the life of the mother), Poelker v. Doe , 432 U.S. 519 (1977), and Webster v. Strong Essay? Reproductive Health Services , 492 U.S. In The? 490, 507-11 (1989). The Court has also upheld federal administrative regulations (since rescinded) requiring physical and financial separation of strong Title X family planning projects from other projects operated by Title X grantees that perform, counsel or refer for abortion, Rust v. Thesis Statement? Sullivan , 500 U.S.

173 (1991). The Court has upheld a requirement that a pathology report be prepared for words all fetal tissue obtained in the course of an abortion, Ashcroft , 462 U.S. at 486-90 , but has struck down a requirement that fetal remains be disposed of in english, a “humane and sanitary manner,” Akron Center I , 462 U.S. at 451-52 . The Court has upheld some record keeping and reporting requirements, Danforth , 428 U.S. at 79-81 , Casey , 505 U.S. at 900-01 , while striking down others, Thornburgh v. American College of Obstetricians Gynecologists , 476 U.S. 747, 765-68 (1986), because of strong essay what the Court perceived as inadequate guarantees of patient confidentiality. The Court has upheld a requirement that a second physician be present during the cause essay world war 1, performance of a post-viability abortion to provide immediate medical care for a viable child who survives an abortion procedure, Ashcroft , 462 U.S. at 482-86 , but has struck down a second-physician requirement that did not contain an express or implied exception for medical emergencies, Thornburgh , 476 U.S. at 769-71 . The Court has also struck down standards of strong care for the performance of post-viability abortions that were either vague, Colautti v. Franklin , 439 U.S. 379, 397-401 (1979), or posed an unacceptable risk to the mother’s health, Thornburgh , 476 U.S. at 768-69 , but has upheld a statute mandating fetal viability testing at twenty weeks’ gestation, Webster , 492 U.S. at 513-21 . In a pair of decisions, later overruled in part by Planned Parenthood v. Of Modern? Casey , 505 U.S.

833 (1992), which is discussed in the next part of this essay, infra , the Court held that States and municipalities could not require a short waiting period before the strong, performance of a non-emergency abortion; that they could not required detailed informed consent information to be given to for frankenstein, the pregnant woman seeking an abortion; and that they could not require portions of the informed consent information to essay words, be conveyed in person to the patient by the attending physician, see Akron Center I , 462 U.S. at 442-51 and Thornburgh , 476 U.S. at 759-65 . 11. IV. Roe Revisited: Planned Parenthood v. Casey ^ top. In 1992, the Supreme Court revisited Roe and, in a Joint Opinion authored by Justices Sandra Day O’Connor, Anthony Kennedy and war 1, David Souter, substantially modified its holdings. Planned Parenthood v. Casey , 505 U.S. 833 (1992). In Casey , the Court reaffirmed what it characterized as the “essential” (or “central”) holding of Roe , consisting of words three parts: First, a woman has “the right . A Selection English Essays? . Strong Essay Words? . . to choose to have an abortion before viability and to obtain it without undue interference from the State. Before viability, the State’s interests are not strong enough to support a prohibition of abortion or the in the, imposition of a substantial obstacle to words, the woman’s effective right to elect the procedure.” 505 U.S. at effect essay war 1 846. Second, the State has the power “to restrict abortions after fetal viability, if the law contains exceptions for pregnancies which endanger the woman’s life or health.” Id . And, third, “the State has legitimate interests from the outset of the pregnancy in protecting the health of the woman and essay, the life of the fetus that may become a child.” Id . While reaffirming the “essential” (or “central”) holding of Roe , the authors of the analysis, Joint Opinion rejected Roe’s “trimester” framework as an unnecessarily “rigid construct” which “in its formulation . Essay Words? . . misconceives the nature of the pregnant woman’s interest,” and “in practice . . . undervalues the State’s interest in potential life . . A Selection Of Modern English Essays? . .” Id . at 872-73.

The trimester framework “misconceives the nature of the strong essay, pregnant woman’s interest” because “[w]hat is at stake is [her] right to make the ultimate decision [to obtain an abortion prior to viability], not a right to be insulated from all others in doing so.” Id . at 877. “Though the analysis for frankenstein, woman has a right to choose to terminate or continue her pregnancy before viability,” the Joint Opinion explained, “it does not at all follow that the State is prohibited from taking steps to strong essay, ensure that [her] choice is thoughtful and informed.” Id . at 872. The trimester framework “undervalues the State’s interest in potential life,” the Joint Opinion continued, because the State has a “substantial state interest in analysis essay for frankenstein, potential life throughout pregnancy,” id . at 876, not just after viability. In light of their dissatisfaction with the trimester framework of Roe and essay, how it had been applied in subsequent cases, the authors of the Joint Opinion developed a new standard for reviewing pre-viability abortion regulations, the so-called “undue burden” test. A Selection English? Casey , 505 U.S. at 874-79. Under that test, “a state regulation [that] has the purpose or effect of placing a substantial obstacle in the path of a woman seeking an strong essay abortion of a nonviable fetus” is cause effect essay world war 1, unconstitutional. Id . at 877. Applying that test to the statutes challenged in Casey (multiple provisions of the Pennsylvania Abortion Control Act of 1982, as amended), a majority of the Court upheld the detailed informed consent requirement (including the mandated twenty-four hour waiting period), the parental consent requirement and essay, the record keeping and reporting requirements, id . at 881-87, 899-901, but a differently constituted majority struck down the spousal notice requirement , id . at 887-98 . 12 In upholding the solving answers, informed consent requirement (and the accompanying waiting period), the Court overruled, in part, its earlier conflicting precedents in Akron Center I and strong essay, Thornburgh . Id . at 881-82. Paper? 13. Both Justice Harry Blackmun and Justice Paul Stevens dissented from the Joint Opinion’s abandonment of Roe’s trimester framework and the strict scrutiny standard of review, while Chief Justice William Rehnquist, joined by Justices Byron White, Antonin Scalia and Clarence Thomas, dissented from the reaffirmation of the “essential” holding of Roe , arguing that the strong words, rational basis standard should be applied to all regulation of essays abortion. 14. The Joint Opinion in Casey is essay words, notable in five respects:

First, in solving for interviews, reaffirming what it characterized as the “essential” (or “central”) holding of Roe , the authors of the Joint Opinion raised the issue but refused to state whether they believed that Roe had been correctly decided as an original matter of constitutional interpretation, Casey , 505 U.S. at 871 (“[w]e do not need to say whether each of us, had we been Members of the Court when the valuation of the state interest [in the protection of “potential life”] came before it as an original matter, would have concluded, as the Roe Court did, that its weight is insufficient to justify a ban on abortions prior to viability even when it is subject to certain exceptions”), 15 relying instead on words, “principles of institutional integrity” and “the rule of stare decisis [deferring to precedent].” Id . at 845-46; see also id. at 854-69. Second, the Joint Opinion provided no principled basis for success distinguishing between the “essential” (or “central”) and the inessential (or peripheral) holdings of Roe , reaffirming the former and overruling the latter. As Justice Scalia commented, “I must . . Strong Words? . Essays? confess that I have always thought, and I think a lot of other people have always thought, that the arbitrary trimester framework, which the Court today discards, was quite as central to Roe as the strong, arbitrary viability test, which the Court today retains.” Id . at 993. (Scalia, J., concurring in the judgment in part and dissenting in part). Third, in reaffirming the “essential” holding of Roe , the Joint Opinion abandoned Roe’s reliance on privacy theory, resting its analysis, instead, on the liberty language of § 1 of the cause effect world, Fourteenth Amendment. Fourth, the Joint Opinion tacitly abandoned Roe’s characterization of the right to strong essay words, abortion as “fundamental.” 16 And, fifth, the Joint Opinion substituted a new standard of review – “undue burden” – in place of the strict scrutiny standard employed in Roe for thesis statement evaluating fundamental rights, which clearly allows for a broader scope of regulation (but not prohibition) of strong essay words pre-viability abortions. 17. The strict scrutiny standard of how to judicial review applies to laws that either interfere with the exercise of a fundamental constitutional right ( e.g ., voting) or discriminate on the basis of a suspect classification ( e.g ., race). A law reviewed under this standard is presumed to be un constitutional and will not be upheld unless its proponents are able to demonstrate that it is strong essay, necessary to essay for frankenstein, promote a compelling state (or governmental) interest.

Few, if any, laws reviewed under this standard survive. Strong? At the opposite end of the spectrum is the rational basis standard of review, which applies to almost all other legislation. 18 Under this standard, a law is presumed to be constitutional and will be upheld so long as it has a rational relationship to any legitimate state (or governmental) purpose. Most laws reviewed under this standard survive constitutional scrutiny. V. The Roberts Court and the Future of Abortion Jurisprudence ^ top. Under the leadership of Chief Justice John Roberts, the Supreme Court has taken a more cautious approach to the review of abortion regulation. Most obviously, the Court, in an opinion by Justice Kennedy, upheld the federal Partial-Birth Abortion Ban Act in Gonzales v. Carhart , 550 U.S. 124 (2007) ( Carhart II ), after a differently constituted Court struck down a similar (but more vaguely worded) state statute only seven years earlier in Stenberg v. Effect? Carhart , 530 U.S.

914 (2000) ( Carhart I ). Less obviously, the Court has suggested that, at least with respect to the regulation of abortion, “facial challenges,” i.e ., a claim that a given statute is unconstitutional in its entirety, are disfavored, Carhart II , 550 U.S. 124 at 130 (“these facial attacks should not have been entertained in the first place”), and “as-applied” challenges, i.e ., a claim that a statute is unconstitutional in particular circumstances, are preferred, id . at 168 (“[a]s-applied challenges are the basic building blocks of constitutional adjudication”) (citation and internal quotation marks omitted). Relatedly, in another decision of the Roberts Court, the essay, Court unanimously held, in an opinion by Justice O’Connor, that when only a limited number of applications of an abortion statute would be unconstitutional, the proper remedy (if otherwise consistent with legislative intent) is to enjoin enforcement of those applications only, not to declare the entire statute unconstitutional. Ayotte v. Planned Parenthood of Northern New England , 546 U.S. Cause Essay World? 320, 328-31 (2006) (reviewing parental notice law). Significantly, in essay, Ayotte , Justice O’Connor acknowledged that the Court did not take this more circumspect approach in Carhart I, id . at 330-31 (explaining that “the parties . Analysis? . . did not ask for, and we did not contemplate, relief more finely drawn” than complete invalidation). Essay Words? 19. In light of the Roberts Court’s more cautious approach to the review of abortion legislation, fewer challenges to abortion statutes may be expected. Moreover, even with respect to those challenges that are brought and essays, are determined to have merit, both the Supreme Court and the lower federal courts are likely to strike down the essay, statute and enjoin its enforcement only with respect to its invalid applications, not in its entirety. VI. A Comment on the Scope of the Health Exception ^ top.

Finally, a brief comment on an unresolved area of how to success in the US abortion law – the scope of the health exception required by essay Roe (as reaffirmed in Casey ). In Roe , the Supreme Court held that the States may prohibit abortion after viability “except when it is necessary to deductive statement, preserve the life or health of the strong words, mother.” 410 U.S. at 164. The Court, however, did not define the term “health.” In the companion case of cause effect world Doe v. Bolton , the strong essay, Court considered a challenge to what remained of the Georgia abortion statute after major provisions of the statute had been declared unconstitutional by US a federal district court. As a result of the district court’s decision, a physician could perform an abortion whenever he determined, in “his best clinical judgment,” that the abortion was “necessary.” At issue in Doe was whether this standard was impermissibly vague. The Court concluded that it was not: [T]he medical judgment [as to whether an abortion is “necessary”] may be exercised in the light of all factors – physical, emotional, psychological, familial, and the woman’s age – relevant to the well-being of the patient. Essay Words? All these factors may relate to health. Whether Doe , properly understood, mandates an writing lined paper open-ended “health” exception for post-viability abortions is debatable. Although there is the merest hint in one older case that the Court (as then constituted) may have regarded the broad language in Doe as a limitation on the State’s authority to strong, prohibit post-viability abortions, see Colautti v. Franklin , 439 U.S. 379, 400 (1979), the Court has never directly considered the validity of a post-viability ban. Lower federal courts have read Doe as a gloss on the scope of the health exception that must be included in english, any post-viability ban, 20 but that reading misinterprets Doe , as Justice Thomas noted in his dissent from the strong essay words, denial of certiorari in Voinovich v. Cause War 1? Women’s Medical Professional Corp . Words? , 523 U.S.

1036 (1998): Our conclusion that the statutory phrase at issue in Doe [whether the abortions was “necessary”] was not vague because it included emotional and psychological considerations in cause essay war 1, no way supports the proposition that, after viability, a mental health exception is essay words, required as a matter of federal constitutional law . Doe simply did not address that question. 523 U.S. at 1039 (emphasis in original). As things now stand, whether the open-ended “health” language of Doe is essay for frankenstein, a limitation on the authority of the words, States to prohibit post-viability abortions remains an open question, but one that should be answered by a challenge to an appropriately drafted statute. Given the present composition of the Court, there is reason to believe that such a statute would be upheld. In recognizing a constitutional right to abortion, the Court in Roe believed that it was meeting the how to in the US, “profound problems of the present day.” 410 U.S. at 165. The “problems” which the Court thought would be ameliorated by its decision included the medical risks associated with pregnancy, a “distressful life and future” for the pregnant woman confronted with an unwanted pregnancy, “[p]sychological harm,” the difficulty in essay words, providing “child care,” “the distress, for all concerned, associated with the unwanted child,” “the problem of bringing a child into a family already unable, psychologically or otherwise, to care for it,” and, for some, “the additional difficulties and continuing stigma associated with unwed motherhood . . . .” Id . at 153. More than thirty years of analysis essay experience with legalized abortion has failed to solve these problems, as well as others for which abortion was touted as a panacea (crime and poverty). Indeed, the regime of strong words legal abortion has aggravated them. See Clarke D. Problem Solving Answers For Interviews? Forsythe and Stephen B. Presser, The Tragic Failure of Roe v. Wade: Why Abortion Should be Returned to the States . 10 Tex.

Rev. of strong words Law Politics 85, 108-36 (Fall 2005). In reaffirming, as modified, Roe in Casey , the Supreme Court “call[ed] the contending sides of a national controversy to solving, end their national division by accepting a common mandate rooted in the Constitution.” 505 U.S. at 867. Given the issues at stake in abortion, that call, not surprisingly, has not been heeded. The abortion liberty has no “roots” in the Nation’s history, traditions and legal practices. And the “national division” over the abortion controversy, which Roe created and Casey continued, will not end until, initially, the Supreme Court returns the issue of abortion to the States and, eventually, the Constitution is amended to protect the lives of all unborn children.

A discussion of the various standards of strong judicial review may be found in Part IV of this essay, infra . back. When Roe was decided, an unborn child was “viable,” i.e ., capable of living outside of his or her mother, at twenty-eight weeks of gestation. In light of medical advances made since Roe , viability may occur at twenty-three to twenty-four weeks, or, in some instances, even earlier, as the Supreme Court recognized almost twenty years ago in Planned Parenthood v. Casey , 505 U.S. Essay? 833, 860 (1992) (noting that viability may occur at twenty-three to twenty-four weeks). back. Section 230.3 of the strong essay words, Model Penal Code, one version or another of which was adopted by thirteen States before Roe v. Wade , allowed abortion whenever the physician believed that there was a “substantial risk” that continuance of the pregnancy “would gravely impair the physical or mental health of the mother,” that “the child would be born with grave physical or mental defect,” or that “the pregnancy resulted from analysis essay for frankenstein rape, incest, or other felonious intercourse.”In Doe , the Court also struck down a requirement that an abortion could be performed only upon a bona fide resident of the essay words, State of Georgia. As a result of the district court's judgment, a physician could perform an abortion whenever, in his best clinical judgment, the a selection of modern english, procedure was necessary. back. Cunningham (eds.), Abortion and the Constitution: Reversing Roe v. Wade Through the Courts (Georgetown University Press 1987), is a compendium of strong essay articles written by lined paper a variety of authors criticizing various aspects of the holdings and analysis in Roe . Strong? The most comprehensive and thorough analysis of Roe's treatment of the historical treatment of abortion in English and cause, American law, as well as the restatement of that history in James C. Mohr's Abortion in America (Oxford University Press 1978), is Joseph W. Dellapenna's Dispelling the strong essay, Myths of Abortion History (Carolina Academic Press 2006) (an extremely abbreviated version of Professor Dellapenna's analysis appears in Abortion and the Constitution , supra , at 137-58). Casey : The Flight from Reason in the Supreme Court , XIII St. Louis U. Pub.

L. Rev. 15, 103-19 (1993). Strong Essay Words? The poor quality of the cause effect essay world, analysis and reasoning in Roe has led some academics to rewrite the opinion. A collection of such opinions and opposing dissents, along with a useful selected bibliography, appears in strong essay, Jack M. Essay For Frankenstein? Balkin (ed.), What Roe v. Essay Words? Wade Should Have Said (New York University Press 2005). back. All of the holdings in these cases, and the full citations thereto, appear in Part I of this essay, supra . back. Planned Parenthood v. Casey is discussed in more detail in Part IV of this essay, infra . back. Justices Oliver Wendell Holmes, Jr., Louis D. Brandeis and Hugo Black, as well as Judge Learned Hand, who served on the Second Circuit Court of Appeals for decades, all agreed that the use of the liberty language of the Due Process Clause to invalidate the substance of state enactments is fundamentally illegitimate. See Berger, Government by deductive thesis statement Judiciary , at 227-28 n. 27 (Black), 282 n. 46 (Holmes, Brandeis and Hand). back. The Court also upheld the medical emergency definition. Casey , 505 U.S. at 879-80. back.

Electronic Medical Records (EMR) Essay Sample. The Beginning: Paper Trail SlumThe medical and healthcare field is essay words, characterized with the cumbersome practice of cause effect war 1 obtaining and maintaining extensive documentation of patient information. Medical staff, physicians and words, healthcare practitioners are legally responsible to maintain a comprehensive, efficient as well as effective way to collect, maintain and cause essay world, archive patient information. Traditionally, this process of information collection and strong, maintenance was accomplished manually resulting in an endless paper trail of information. Everything from patient encounters to informational charts to billing was executed in a paper based environment and soon this record keeping method became too overbearing and tedious to manage.

The integrity of this manual paper-based process continued to be compromised with issues surrounding the convenience, data mining ability, cost and safety of this method. The ability to effectively communicate among different personnel and patients and obtain on time information was rapidly decreasing when it came to this traditional method. With the world, advent of technological advances and its many application, players within the strong words, medical field like in world any other field, were looking for ways to be more efficient in their health care processes. A new lifeline was obtained when the introduction of the computer paved the way for more automation in this field. The computer is considered a tool to promote communication. In the strong essay, medical arena, a moment between life and death or sickness and health is contingent upon communication or the lack there of. Computers have been instrumental in facilitating many areas in the management of medical records, and with its introduction into the medical field about 30 years ago, experts believed its involvement would provide several advantages in the medical profession. With a strong push to integrate the computer and technology into the administration of services within the essay for frankenstein, medical field, more executives are adopting Electronic Medical Report (EMR) systems to strong essay streamline the lined paper, patient record maintenance process. It’s a normal trend for words, clinical departments to work for years with their own people, budget, and vendors to come up with a method of capturing their patient and billing data electronically, and that personalized method is one definition of an EMR.

In actual fact, one point of argument regarding EMRs is simply a question of semantics. Deductive Thesis. There are various definitions for essay, an EMR. Problem Solving Answers For Interviews. At one end of the scale, an EMR includes everything from patient’s past medical history to diet and lifestyle preferences. Essay. At the writing paper, other end, it can be as simple as an e-mail message to a fellow clinician. Our definition of an EMR is essay, simply a repository of clinically important data that may be accessed and searched with relative ease and in a rapid manner. Most of us would be extremely content with something easily learned, easily understood, and relatively inexpensive. The Future: Technology’s PlaygroundToday, the use of for frankenstein EMR systems has revolutionized the essay, medical field industry by facilitating a more efficient record keeping process and a more effective communication medium for medical personnel to exchange information. Many healthcare personnel now understand the writing lined paper, importance and the impact these EMR systems are having on the overall delivery of customer service and strong essay words, the general administration of of modern healthcare.

Medical practitioners are constantly faced with challenges including the need to improve the quality of care, adhere to new clinical restrictions and processes, reduce waste and reduce errors. In recent times these challenges have been less of a burden as automated integrated systems help coordinate such process much better. Computerized systems like EMR systems help in reducing the amount of paperwork for medical offices, providing an easier way to strong words access patient information, promoting more uniform delivery of processes and in some respects suggesting appropriate diagnosis and treatment for analysis, certain conditions. The concept of an EMR system lies on the idea of a centralized informational power house that can provide orderliness in essay a once chaotic paper based environment. Its tangible value is evident in the opportunity to promote Data Mining or store data in one place and visibly extract or filter desired necessary information at a more expedient fashion. However for an EMR system to be effective in its function, it needs to be centralized onto a database where data can be easily shared amongst health care providers and hospitals. In today’s economic environments, costs and return on how to in the US investment are just as important as the diagnostic process, moving to a more accessible and rapid electronic system has obvious benefits. Words. Very few would argue the fact that an EMR has value over a printed chart when it comes to identifying practice patterns, assigning probabilities to diagnoses, locating inefficiencies in patient care, delivering reports to of modern patients and consulting services rapidly, and achieving prompt billing. With digital form gaining traction in the medical industry, medical records can be automatically scanned for everything from potential drug interactions to gaps in clinical data that may affect reimbursement. In addition, a computer program can be used to strong essay automatically generate reminders for physicians and patients. Specific examples described below illustrate the potential benefit.

Paper charts maintained by individual physicians have their own limitations, and is evident during most office visits. At the beginning of a patients visit, they are required to provide a list of success in the medical history, from family medical history, medication, prior and strong essay words, existing conditions. Due to medical charts rarely being shared by multiple providers, it is normal to see this information collected by each health care provider and often times collected on more than one occasion by the same provider. The amount of information required by for frankenstein, each patient at the start of each office visit will depend upon the age or medical condition of the patients and can be a substantial amount. Patients not only resent having to recall this information on multiple occasions, but on occasion unintentionally omit critical pieces of information. The implementation of an EMR would reduce the need for redundant data collection and essay, allow care providers to assess the same medical records. Care providers can quickly review the history and update the medical records where necessary. In some emergency cases where the patient or family is unable to provide medical history, having prior data available would be invaluable (e.g., patients with Alzheimer, unconscious patients). Over a period of time patient charts usually contain considerable data regarding patient vitals from lined, heart rate, blood pressure, and strong essay words, temperature to laboratory results such as, blood counts, blood sugars level. While discrete measures can be compared to norms, often times time trended data provides a more accurate view of a medical condition or concern to physicians.

Physicians relying on paper charts are only able to create simple charts and deductive thesis, would be impractical for them to create graphical displays for each clinical measure lending itself to a graphical representationWith EMR, generation and strong essay words, reviewing of graphical representations of one or more measures for a period of time would become a quick and easy task for physician. Graphical displays showing increasing blood pressure or blood sugar levels might alert care givers of an emerging problem and therefore help reinforce the severity with the patient. When physicians determine the medication to prescribe to patients, they must consider both efficacy and how to success, cost. Prescribing medications that are beyond the economic means of patients is counter-productive. This can be prescribing medications that are either not included in essay words patients insurance plan or require a generic to qualify for a co-pay56. In The. Given the increase rate in strong medication options and variation, and cause effect essay world war 1, the rate of change in health care insurance benefits it impossible for physicians to quickly compare the various options when using paper based systems. As a result, most patients do not learn the cost of essay medications nor the extent, if any, of insurance coverage until they present the prescription to a pharmacy. Patients, upon a selection english learning from the pharmacy that lower cost generics are available or that generics or other similar medications would be covered by insurance, frequently request that the physician prescribe an alternative medication. These requests are time consuming for words, the patient, provider and pharmacy. With an EMR system, a care provider can assess whether a medication is covered by a patient’s insurance and discuss alternatives with them at writing paper the point of strong words examination.

EMRs can deliver this functionality by exploiting databases for both insurance plan formularies as well as on medications FDA approved. In an cause war 1, EMR setting the strong, physician can discuss medication options, by assessing the level of insurance coverage during the examination itself. Ultimately, EMR can help us to reduce cost. Success In The US. These are expenses associated to paper charts, poor documentation and high malpractice premiums, as well as new expenses as a result of strong essay support contracts, computer maintenance and product updates. Paper. Reducing paper chart costs including purchasing stationary, copying, printing, management and storage is the clearest benefit of EMR.

Transcription costs can also be reduced as EMR can provide an easier means for patient documentation and report writing. EMR also avoid the cost of hiring new staff during peak time by becoming more efficient with the EMR system. At the same time EMR will avoid expensive medications by offering patients more cost effective alternatives. It also can help keep our malpractice premiums lower as a result of higher quality documentation and drug prescription alerts. However, there have been some disadvantages to the use of computerized systems which has influenced the low adoption rate of words EMR systems and their like. How To Success US. These disadvantages include high cost of implementation of such systems, failure to strong words meet the firm’s objective, security and confidentiality issues regarding patient information as well as an increase in malpractice lawsuits. EMR systems are also very difficult to implement because existing electronic data sources (e.g., laboratory, pharmacy and physician dictation systems) reside on many isolated islands with differing structures, levels of granularity and different code systems.

This issue is prevalent in the case of promoting cross-institutional clinical care and research, where unique system designs coupled with a lack of standards have led to this difficulty. Nevertheless, with the backing of the statement, legislative and executive bodies, the use of EMR systems will soon be nationwide. President George W. Bush, in an attempt to encourage the push for incorporating American medicine into the information age, commented during a press release in Collinsville, January 5, 2005, “We need to apply 21st-Century information technology to words the health care field. We need to have our medical records put onto IT.” With three significant Federal mandates issued regarding the cause effect war 1, adoption of EMR, we will gradually see a more computerized approach to medical practice during the next coming years. Technology’s Nemesis: A Concern for PrivacyIn most EMR debates the most pressing concern is the issue regarding security and privacy. Words. According to a Harris Interactive online media poll, 68% of respondents believe that the use of EMRs can improve the quality of success care patients receive. However, most respondents also believe that EMRs make is more difficult to ensure privacy. As more provider groups, hospitals, and strong essay words, integrated health systems implement EMRs, concerns over patient privacy and ethical uses of data have also increased.

The Health Insurance Portability and Accountability Act of 1996 (HIPAA) established strict guidelines for patient privacy. Among these, HIPAA created a minimum threshold of when private health information (PHI) can be shared. HIPAA also established standards for electronic health care transactions. Although the world, expectation is that electronic records can have better controls than paper charts, there are certain steps that health care organizations must take into account in order to reduce the risk of releasing privacy information:•Each office member must have a password in order to log into the EMR system. The password must never be shared with others and should be considered an electronic signature. •Different levels of system access should be provided based on the user’s job responsibilities. Strong Words. Some roles may only require the billing code and not the results of cause effect essay war 1 lab work. •When not actively using the strong words, system, the user must log off to prevent anyone from US, accessing the information. •The system must maintain an audit trail that can tie system use back to the username. •If accessing the system remotely, the connection must be secure.

The user must prevent those around them from viewing any information. •Any information printed from the system must be filed within the appropriate location or shredded immediately. EMRs integrate so many areas of the health care system under one basic heading. Essay. For example, Kaiser Permanente is an thesis statement, integrated health care delivery system. Kaiser serves as a pre-paid health insurance plan that maintains its own hospital facilities and ambulatory facilities, contracts with its own medical group (Permanente), operates its own pharmacy, and strong essay, also contracts with separate existing hospitals.

Kaiser recently developed an EMR system that can automatically track utilization for essay, their members for all services, including outpatient, inpatient, and pharmacy. Clinicians have access to the patient’s medical history, putting them in a position to better manage care. Words. Privacy under this integrated model becomes a concern as there are so many parties with access to writing paper PHI. Instead of an individual office being required to uphold privacy standards, the entire model must work together. Not everyone at the hospital has the need to know about the physician’s office visit from two years ago. One of HIPAA’s requirements is to only share the minimum information necessary. Although HIPAA was passed with the intent to assure privacy, many argue that this intent was reversed in 2002 when the strong words, HIPAA Privacy Rule was amended by the Department of cause essay Health and Human Services. The amendment limited how much control Americans would have over words who could access their PHI. This is further complicated now due the push toward a national health care technology networking system that would integrate EMRs and even create what are considered Personal Health Records. English Essays. The health information would be compiled by over 600,000 different sources.

In addition to these sources having access to posting the essay words, record information, they would also have access to a selection of modern pulling PHI. Rather than having individual doctors offices track their own patients electronically, there would be a combined network providing immediate access to all patient records. The development of such a system creates significant privacy and ethical concerns over different segments:EmployersMany large employers self-insure their health care benefit programs. One of the advantages of the self-insured model is it allows employers to better manage the costs and strong essay, risks of their population. The intent of HIPAA was to success limit the level of words detailed information the employer could receive. Through the integrated EMR system, there is the cause world war 1, potential for strong, sensitive data to become more readily available directly to the employer or through business relationships.

Privacy infringements could lead to such ethical issues, including employee discrimination. Under the in the, Kaiser Permanente example, the employer hired Kaiser to serve as the insurer, the physician’s group, and strong essay words, the hospital. Once the physician’s office enters medical information for thesis statement, a patient, it is possible that the pharmacy, the hospital, and the finance areas all might gain access to essay words the patient’s health record. There is the possibility this could somehow make it back to the employer. It is critical for employers to not only meet the minimum threshold established by HIPAA, but they also must have clear policies outline to mitigate any potential discrimination against employees. GovernmentThere is the english essays, fear that a government established electronic health system would provide government agencies with immediate access to strong essay words PHI. One of the original intents of HIPAA was to prevent the lined paper, government from accessing specific health care information. Without a right of essay consent provision, Americans would not have an opportunity to prevent their medical records from being shared with the government. Similar to employer’s discriminating against their employees; there is also the cause effect, fear of the government discriminating against its citizens due to health care related issues. The integrated EMR system could enhance public health efforts as more data would be readily accessible and easier to analyze. This all leads to the ethical questions of how much information a government should have on its citizens and where to draw the line between overall public health and individual health rights.

Physicians/Health Care WorkersPhysicians and health care workers are looking for a system that provides them with clear information on a patient’s medical history. Words. The notion is that through more accurate and complete historical information, they can help improve the of modern, quality outcomes for the patient. In the process of receiving the strong essay words, historical medical information, physicians must also look forward to how their findings would be used in the future. Doctors must uphold an ethical standard required by the Hippocratic Oath. Physicians are not to disclose patient medical issues without the consent of the patient. EMRs that go beyond the limited basis of a selection of modern english essays a physician’s office or a hospital means that doctors could be providing information to other parties without the patient’s approval. These groups might include, but are not limited to corporations, individuals, and government sectors. As the push for technological integration in the medical field becomes more widespread, it is very pertinent that we consider both the pros as well as the strong words, cons of this application and implement the necessary checks and balances in order to reap substantial benefits and world, stay clear of any potential setbacks.

Pacing Forward: EMR Best Practices FrameworkIn order to sustain a well efficient EMR system guaranteed to words support business processes and to maintain a streamlined process, documented below is an EMR setup framework, which when adopted could promote the best outcome in regards to system functionality and performance. This framework is divided up into phases: planning, testing, training and go live. Planning Phase•Identify goals and base planning strategies around these goals. •Decide data required. •A phased implementation is highly recommended. Phased implementation work well for EMR because many of their functions are in discrete modules such as lab order entry, messaging, preventive health maintenance, patient tracking, e-prescribing etc. •Create timelines, but be flexible. Constantly evaluate progress of the implementation process along the way, and ensure resource commitment in aligned to the timeline. •Perform a workflow analysis. Strong Essay Words. Identify an in-house key person on staff to oversee the entire project. Communicate to the staff the how to success in the, practice’s desire to acquire an EMR before the purchase. Seek employee input and include them in the decision of which EMR vendor to choose. Be aware that support staff may feel that they could be replaced by strong words, an EMR. In certain cases this may be accurate particularly with clerical clerks. Have end-user staff be involved in the system set-up. Map out Workflows utilizing current staff members: Map out current workflows on how to success in the US paper and bring in the end-users who perform the current workflows to help design new workflows for the EMR. Establish access thresholds based on the different roles and responsibilities of strong essay each staff member. Ensure sufficient time for learning curves. Problem Solving Answers For Interviews. The learning curve for complete and successful adoption of the EMR is usually vastly underestimated. Testing Phase•Software/Hardware Testing:Test software extensively before implementation.

Perform Volume testing, if possible. Use a typical day and do a dry run in a test database. Ask for a list of known bugs from the vendor. Create work-around and strong words, identify dates for patch fixes if required. •Hardware Testing:Prepare Infrastructure•Staff and TestingPilot systems before implementation. Pilot workflows, procedures, modules, templates, documentation time etc. in a live environment utilizing a small group of staff long before go-live.

•Allocate sufficient time for training, including specific instructions on HIPAA and privacy requirements. •Training should be performed outside of clinical work sessions. •Set-up a training room for staff to problem for interviews practice. •Appoint Super users. •Evaluate staff’s readiness for go-live. Go-Live Phase•Schedule the go-live in close proximity to the end of the training sessions. •Reduce provider schedules: Reduce the number of patients a provider is required to see during the go-live phase.

•Provider Adequate Resources. Be certain to words supply the staff with well trained individuals such as vendor trainers, super users, in-house project manager etc. during the go-live phase. •Post Go-Live Assessment is how to success US, necessary. •Evaluate the strong essay, Go-Live with Staff: Query the staff regarding the go-live process.
